1. UPDATION

We reserve the right to update, amend, or modify these Terms of Usage at any time. It is the User’s responsibility to periodically review the Terms to ensure continued compliance.

2. USER CONSENT

By accessing or using the Website, you (“Member”, “You”, “Your”) agree to be bound by these Terms of Usage. If you do not agree, please do not use or access the Website or click “I AGREE.” Continued usage of the Website after changes implies your acceptance of the updated Terms.

3. GENERAL DESCRIPTION

Jaibhakti is an online platform available via the Web, App, and other electronic mediums that provides spiritual and devotional content, consultations, rituals, and guidance (hereinafter referred to as “Content”).

The Website offers:

  • Free Services – accessible without registration.
  • Paid Services – available after registration as a Member.

By registering for Paid Services, the User agrees to:

  • Provide accurate, complete, and current personal details.
  • Update information promptly to maintain accuracy.

4. REGISTRATION AND ELIGIBILITY

  • By using the Website, you confirm that you are 18 years or older and capable of entering into a binding agreement as per the Indian Contract Act, 1872.
  • The Website is not responsible for misuse by minors. However, questions related to minors in your family are permissible.
  • Account creation requires a valid mobile number and OTP, or login via Gmail, Facebook, or other authorized services.
  • Users must not register multiple accounts using different numbers.
  • Use of another person’s account is strictly prohibited.
  • You are responsible for maintaining the confidentiality of your account credentials.
  • You must log out at the end of each session.
  • You agree to receive notifications from Jaibhakti via SMS, WhatsApp, RCS, push notifications, or other digital mediums.

5. THIRD-PARTY SERVICES

Some services may be provided by third-party spiritual consultants or vendors. Jaibhakti is not responsible for:

  • The accuracy of third-party information.
  • Any loss arising from interactions with such third parties.

6. PAYMENT & DATA SECURITY/h3>

While Jaibhakti and its payment providers aim to ensure secure transactions, digital transactions always carry minor risks. You agree and understand that:

  • You must provide accurate payment data.
  • Despite precautions, fraud or misuse may still occur and are beyond our control.

7. USE RESTRICTIONS

The following are not permitted:

  • Users from jurisdictions where our services are prohibited.
  • Residents of regions where trade or engagement in such spiritual services is restricted by law.
  • Use of multiple or fake accounts.
  • Any user behavior that violates these Terms or applicable laws.

8. FEATURE: “CALL WITH SPIRITUAL GUIDE”

Jaibhakti offers services via telephonic communication with listed spiritual guides. By agreeing to these Terms, you authorize us to call you, even if your number is registered on a DND list.

10. WEBSITE CONTENT USAGE

  • All content on Jaibhakti, including links and advice, is proprietary.
  • The User must not post unlawful, abusive, defamatory, or obscene content.
  • Violators may have their access suspended or accounts terminated.
  • Jaibhakti may change or remove features, content, or services without prior notice.

11. MEDICAL DISCLAIMER

  • Any spiritual or astrological advice is not to be construed as medical advice.
  • Jaibhakti does not guarantee results from advice or rituals.
  • Always consult certified health professionals for medical or psychological concerns.
  • Jaibhakti does not endorse specific products, rituals, or practices unless explicitly stated.

12. LIABILITY

  • Jaibhakti is not liable for outcomes based on spiritual guidance.
  • Disputes or grievances against consultants or third-party service providers must be addressed directly with them.
  • Jaibhakti’s liability is limited strictly to the services it directly provides.

13. USER ACCOUNT ACCESS

Jaibhakti reserves the right to access user accounts to:

  • Improve service quality.
  • Investigate complaints or security issues.
  • Resolve disputes.

14. PRIVACY POLICY

By using this Website, you agree that you have read and understood the Privacy Policy of Jaibhakti. You accept its terms and consent to any future updates displayed on the Website.

15. BREACH AND TERMINATION

The Website may, in whole or in part, without informing the User, modify, discontinue, change or alter the services ordered or the Account of the User registered with the Website. The Website may or may not issue notice or provide any reason for such action taken by the Website.

Violation of any conditions mentioned in these Terms of Usage shall lead to immediate cancellation of the Registration of the User. The Website reserves the right to terminate and initiate action immediately, if:

  • The Website is not able to verify and authenticate the Registration data or any other relevant information provided by the User.
  • The Website believes that the actions of the User may cause legal liability for the Website, other Users, or any service provider linked with the Website.
  • The Website believes that the User has provided false or misleading Registration Data, or has interfered with other Users or the administration of services, or has violated the Privacy Policy.

For Service Providers, including Spiritual Guides, you understand and agree that your relationship with the Website is limited to being a member and you act exclusively on your own behalf and benefit. The Website may terminate and deactivate the profile of such a Service Provider for any violation of the Terms of Usage or agreed-upon Service Terms and Conditions.

16. DELIVERY, CANCELLATION AND REFUND

  • No refund shall be processed for report orders once they have reached the “processing” (Assigned to a Spiritual Guide) stage.
  • No refund shall be processed once an order is executed. If cancellation is requested within 1 hour of payment, the Website may choose to process a refund at its discretion.
  • Technical delays or glitches during report processing are not grounds for a refund.
  • No refund shall be processed for incorrect data provided by the User. Changes must be requested within 1 hour of service execution.
  • No refund will be issued for returned damaged products. The User bears full responsibility for damage after delivery.
  • Orders via Cash on Delivery that are returned will still be charged for product cost and applicable fees.
  • Refunds on a pro-rata basis may be issued for delays in subscription activation. Transit damages will be handled by Jaibhakti and its agents. Verified refunds will be made within 10 business days.
  • Product images are for reference only. No refunds will be issued based on dissatisfaction with product appearance.
  • Services and products are not substitutes for emotional, medical, or philosophical treatment. No claims are made on astrological or spiritual outcomes. Orders are placed at the User's sole discretion and risk.
  • No refund will be processed for incorrect contact numbers in "Call with Spiritual Guide" service. Users must ensure call coverage and availability.
  • Refunds will be subject to deductions: transaction charges, shipping/courier fees, customs duties, and other processing charges as applicable.
  • If experiencing server-related issues (e.g. slow down, timeout), Users must check whether the transaction was successful before retrying. Refunds for duplicate payments will be made in full except for one successful order.
  • Jaibhakti reserves the right to cancel any order for reasons including, but not limited to: service unavailability, pricing errors, or technical problems. Paid charges will be refunded if an order is canceled by Jaibhakti.

By requesting a refund, the User grants Jaibhakti’s quality audit team permission to access chat/call recordings to determine refund eligibility.

  • Refunds may be issued to the User’s Jaibhakti wallet within 72 hours if quality criteria are not met.
  • All refunds will be credited to the User’s Jaibhakti wallet.

Refunds will only be considered in the following cases:

  • Call or chat affected by poor network, background noise, or low audio quality.
  • Spiritual Guide unable to communicate fluently in the listed language.
  • Delayed responses from the Spiritual Guide during session.
  • Irrelevant or inappropriate responses from the Spiritual Guide to the User’s query.

Please Note: No refund will be given for consultations perceived as inaccurate. Jaibhakti holds no responsibility for factual accuracy of consultations.

No physical product is shipped outside India. Products requiring physical delivery are deliverable within India only.

17. USER OBLIGATION

The User (inclusive of the astrologer and the Member Customer) is obligated not to violate the privacy policy, terms and conditions, and any other defined policies on the Jai Bhakti website. The User affirms they are an individual and not a corporation or other legal entity. The right to use Jai Bhakti’s services is personal to the User. The User must not violate these terms, including but not limited to:

  • Posting or transmitting false, defamatory, harmful, harassing, racist, or illegal content.
  • Uploading content without legal or contractual rights to do so.
  • Uploading content that infringes on any intellectual property rights.
  • Collecting email addresses or contact information for unsolicited messages or promotions.
  • Sending spam, chain mails, or unauthorized advertisements.
  • Uploading viruses or malware that can harm the website or other users.
  • Engaging in activities that interfere with or disrupt website access.
  • Trying to gain unauthorized access to any part of the Jai Bhakti website or related systems.
  • Violating any applicable local, national, or international laws.
  • Reselling or using Jai Bhakti services commercially without written permission.
  • Reverse engineering or reproducing content/software from the website.

Additionally, the User agrees to:

  • Receive communication via app, website, SMS, email, or WhatsApp regarding service usage.
  • Not transmit objectionable or unlawful content.
  • Not promote criminal behavior or violate laws.
  • Respect the rights of other users and not disrupt their experience.
  • Report misuse or violations of the platform to Jai Bhakti’s support team.
  • Avoid submitting false complaints, which may result in membership termination.

Jai Bhakti reserves the right to restrict services to users who act abusively with service providers (e.g., astrologers) or misuse the platform. In severe cases, users may be banned and any wallet balance refunded after deducting applicable charges.

18. BANK ACCOUNT INFORMATION

Users are required to provide valid banking information when necessary. Obligations include:

  • Using only debit/credit cards owned by them or used with legal authorization.
  • Providing accurate and correct bank/card details.
  • Ensuring sufficient balance for processing payments.

If any part of these Terms is found invalid, such provisions will be replaced with valid ones, and the rest will remain effective.

19. DISCLAIMER / LIMITATION OF LIABILITY / WARRANTY

The User acknowledges and agrees that services on Jai Bhakti are provided "as is", without warranties of any kind. Astrological guidance is based on personal interpretations and may vary.

  • Jai Bhakti verifies astrologers but does not guarantee their advice, remedies, or predictions.
  • No assurance is given regarding uninterrupted, timely, or accurate services.
  • Users must provide complete and honest information for accurate guidance.
  • Jai Bhakti is not liable for:
    • Unauthorized use of user accounts.
    • Errors or omissions in service content or communication.
    • Downtime due to maintenance or unforeseen issues.
    • Loss of data or damages due to content downloads.
  • Services are for entertainment purposes only. No warranty is provided regarding accuracy, usefulness, or outcomes of advice, content, or purchases.
  • Astrologers are independent and not employees of Jai Bhakti. Their advice is not endorsed or guaranteed by Jai Bhakti.

Jai Bhakti is not a mental health or suicide helpline. If you're experiencing suicidal thoughts, please contact a professional helpline like AASRA at 91-22-27546669.

Under no circumstance shall Jai Bhakti or its affiliates be liable for any direct, indirect, incidental, special, or consequential damages arising from use or inability to use the services or content on the platform.

20. INDEMNIFICATION

The User shall indemnify, defend, and hold harmless Jaibhakti and its parent, subsidiaries, affiliates, officers, directors, employees, suppliers, consultants, and agents from any and all third-party claims, liability, damages, and/or costs (including, but not limited to, attorney’s fees) arising from Your use of the Services, Your violation of the Privacy Policy or these Terms of Service, or Your violation of any third party's rights. These Terms of Service will inure to the benefit of Jaibhakti’s successors, assigns, and licensees.

21. PROPRIETARY RIGHTS TO CONTENT

The User acknowledges that the Content, including but not limited to text, software, music, sound, photographs, video, graphics or other material contained in sponsor advertisements or distributed via email, commercially produced information presented to Member by Jaibhakti, its suppliers, and/or advertisers, is protected by copyrights, trademarks, service marks, patents, and/or other proprietary rights and laws.

The User is not permitted to copy, use, reproduce, distribute, perform, display, or create derivative works from the Content unless expressly authorized by Jaibhakti, its suppliers, or advertisers. Moreover, the content such as images, text, designs, etc. used on Jaibhakti’s portals may have been sourced from various online platforms. Jaibhakti is not liable for any copyright infringement resulting from this content.

22. NOTICES

Except as otherwise stated in these Terms of Service, all notices to a party shall be in writing and shall be made either via email or postal mail. Notice shall be deemed given 24 hours after an email is sent, or 3 days after deposit in postal mail, to the Member at the address provided in the Registration Data and to Jaibhakti at the address:

23. RESTRICTED CONTENT

Child Endangerment

Jaibhakti prohibits users from uploading or distributing content that exploits or harms children. This includes:

  • Inappropriate interaction targeted at a child
  • Child grooming
  • Sexualization of a minor
  • Sextortion
  • Child trafficking

Content that appeals to children but contains adult themes is also prohibited, such as:

  • Excessive violence or gore
  • Harmful and dangerous activities
  • Content promoting negative body/self-image like plastic surgery for entertainment

Inappropriate Content

Jaibhakti does not allow sexual content, profanity, or content meant to sexually gratify. Violations include:

  • Sexually suggestive nudity or poses
  • Sexual illustrations or animations
  • Sexual aids or guides
  • Lewd or profane language
  • Bestiality content
  • Escort or sexual services
  • Content that objectifies or degrades individuals
  • Non-consensual sexual content (e.g., creepshots, deepfakes)

Hate Speech

Jaibhakti does not allow hate speech targeting individuals or groups based on:

  • Race or ethnicity
  • Religion
  • Disability
  • Age
  • Nationality or immigration status
  • Gender or sexual orientation
  • Caste

Violence

We don’t allow:

  • Realistic violence or threats
  • Self-harm, suicide, or eating disorder content

Terrorist Content

Jaibhakti prohibits any terrorist-related content including promotion, incitement, or celebration of terrorist acts.

Dangerous Organizations and Movements

We do not allow content related to planning or glorifying violence against civilians by any organization.

Sensitive Events

Prohibited content includes:

  • Insensitive content around real-life deaths or tragedies
  • Denial of major tragic events
  • Profit from tragedies without benefit to victims

Bullying and Harassment

We do not allow:

  • Content that humiliates or exploits others
  • Content harassing victims of tragedies
  • Blackmail or public shaming

Dangerous Products

Prohibited actions include:

  • Sale or instructions for weapons, explosives, firearms
  • Sale of psychotropic drugs or tobacco products
  • Promotion of inappropriate alcohol or drug use

Black Magic, Witchcraft, Voodoo and Tantrism

Jaibhakti strictly prohibits any form of black magic, witchcraft, voodoo, or tantrism. Accounts found promoting such practices may be deleted.

24. THIRD PARTY CONTENT

Jaibhakti is not liable for third-party websites linked through its platform or the content of its users. Jaibhakti does not control third-party content and cannot be held responsible for any damages arising from its use.

25. ERRORS, CORRECTIONS, AND MODIFICATIONS

Jaibhakti does not guarantee error-free functionality or virus-free access. The platform reserves the right to update, remove, or modify content or services at any time without notice. Jaibhakti will not be liable for any interruptions or modifications to its services.

26. GOVERNING LAW AND JURISDICTION

Any disputes will be settled under the Arbitration and Conciliation Act, 1996. The seat of arbitration will be New Delhi, India. All proceedings will be in English. Interim relief may be sought through courts in New Delhi, and both parties submit to this jurisdiction. These Terms are governed by the laws of India.
